Welcome to Bhara.com (ভাড়া.কম). By accessing or using our platform, you agree to be bound by these Terms of Service. Please read them carefully before using our services.
Important Notice
- •Bhara.com is a platform that connects property owners and tenants directly - we are NOT a real estate broker or agent
- •We do not own, manage, or verify the properties listed on our platform
- •Users are responsible for verifying property details and conducting due diligence before any rental agreement
- •By using Bhara.com, you agree to these terms and our Privacy Policy
1. Acceptance of Terms
By creating an account, accessing, or using Bhara.com, you agree to:
- Comply with these Terms of Service and all applicable laws and regulations of Bangladesh
- Accept our Privacy Policy
- Be at least 18 years of age or have parental/guardian consent
- Provide accurate and complete information during registration
- Use the platform only for lawful purposes related to rental property search or listing
If you do not agree to these terms, you must not use our services.
2. User Accounts and Registration
2.1 Account Creation
- You can register using your phone number (with OTP verification), email and password, or Google account
- You must provide accurate information (name, phone number, email)
- Phone verification is required before posting listings
- One account per person - multiple accounts are prohibited
2.2 Account Security
- You are responsible for maintaining the confidentiality of your password and account
- You must notify us immediately of any unauthorized access or security breach
- We are not liable for any loss or damage from your failure to secure your account
- Do not share your account credentials with anyone
2.3 Account Termination
- You can delete your account anytime from Settings → Danger Zone
- We reserve the right to suspend or terminate accounts that violate these terms
- Upon termination, your listings will be deactivated and eventually deleted
- Subscription fees are non-refundable upon voluntary account deletion
3. Property Listings
3.1 Posting Listings
When posting a property listing, you agree that:
- You have the legal right to list the property (owner, authorized agent, or have owner's permission)
- All information provided (photos, description, rent, location, amenities) is accurate and truthful
- Photos are of the actual property and not misleading stock images
- The property is available for rent and not already rented
- You will update or remove the listing promptly when the property is no longer available
3.2 Listing Review and Approval
- All listings are subject to admin review before being published
- We reserve the right to reject, remove, or modify listings that violate our policies
- Review typically takes 24-48 hours
- We may request additional verification documents for certain listings
3.3 Prohibited Listings
You may NOT post listings that:
- Contain false, misleading, or fraudulent information
- Use photos that don't belong to you or misrepresent the property
- Discriminate based on religion, gender, ethnicity, or other protected characteristics
- Violate any local laws or regulations
- Include contact information in photos or descriptions (to bypass platform features)
- Are duplicates of existing listings
- Promote illegal activities or unsafe living conditions
3.4 Listing Ownership
- You retain ownership of your listing content (photos, descriptions)
- By posting, you grant Bhara.com a non-exclusive, worldwide license to display and promote your listing
- We may feature your listing in search results, homepage, marketing materials, and social media
- We will not sell or transfer your listing content to third parties
4. User Conduct and Prohibited Activities
You agree NOT to:
- Fraud or Scams: Post fake listings, impersonate others, or engage in fraudulent activities
- Harassment: Abuse, threaten, or harass other users
- Spam: Send unsolicited messages, bulk contacts, or promotional content
- Platform Abuse: Circumvent features, contact limits, or verification requirements
- Data Scraping: Use bots, scrapers, or automated tools to collect data from our platform
- Security Violations: Attempt to hack, breach security, or gain unauthorized access
- Intellectual Property: Violate copyrights, trademarks, or other intellectual property rights
- Illegal Activities: Use the platform for any unlawful purpose
- Off-Platform Transactions: Intentionally bypass platform features to avoid subscription fees
5. Subscriptions and Payments
5.1 Subscription Plans
We offer the following subscription plans (see Pricing page for details):
- Free Plan: Limited contact requests (5/month), basic features
- Seeker Plan (৳999): 20 contacts/month for tenants
- Helper Plan (৳2,499): 50 contacts/month + Property Assistant service
- Guaranteed Plan (৳3,999): Unlimited contacts + Full refund guarantee (45 days)
- Owner Plans: Quick (৳999), Success (৳2,999), Guaranteed (৳4,999)
5.2 Payment Terms
- Payments are processed securely through SSLCommerz (Bangladesh's leading payment gateway)
- All prices are in Bangladeshi Taka (BDT/৳) and include applicable taxes
- Subscription duration is 30 days from purchase date unless otherwise specified
- Contact limits reset monthly on your subscription renewal date
- Payment card details are never stored on our servers
5.3 Refund Policy
Guaranteed Plans: Full refund if you don't find a property within 45 days (terms apply)
Other Plans: Generally non-refundable, but we may issue refunds at our discretion for:
- Technical issues preventing service access
- Duplicate charges or billing errors
- Service not delivered as promised
Refund requests must be submitted within 7 days of purchase to support@bhara.com
5.4 Auto-Renewal
- Subscriptions do NOT auto-renew - you must manually renew when expired
- You will receive email notifications 7 days before your subscription expires
- Unused contact requests do not roll over to the next billing period
6. Disclaimer of Warranties
IMPORTANT - PLEASE READ CAREFULLY:
- Platform "As-Is": Bhara.com is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied
- No Property Verification: We do NOT verify, inspect, or guarantee the accuracy of property listings, photos, or owner information
- User Responsibility: You are solely responsible for verifying property details, conducting property visits, and negotiating rental agreements
- No Guarantee of Results: We do not guarantee that you will find a property or tenant, even with paid subscriptions
- Third-Party Content: We are not responsible for user-generated content or listings posted by users
- Service Availability: We do not guarantee uninterrupted, error-free, or secure access to the platform
7. Limitation of Liability
To the maximum extent permitted by Bangladesh law:
- No Liability for User Actions: Bhara.com is NOT liable for any disputes, damages, or losses arising from interactions between users (tenants and property owners)
- No Liability for Listings: We are not responsible for fraudulent listings, inaccurate information, or property condition
- Financial Limit: Our total liability to you for any claims shall not exceed the amount you paid to us in the past 12 months (or ৳1,000, whichever is less)
- Excluded Damages: We are not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, data loss, or business interruption)
- User Disputes: You agree to resolve disputes directly with other users. Bhara.com is not a party to rental agreements
Important: Always meet property owners in person, verify their identity, inspect the property, and sign a written rental agreement. Never transfer money without proper documentation.
8. Indemnification
You agree to indemnify, defend, and hold harmless Bhara.com, its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your violation of these Terms of Service
- Your use or misuse of the platform
- Your listings or content posted on the platform
- Your interactions with other users
- Your violation of any laws or third-party rights
9. Dispute Resolution and Governing Law
9.1 Governing Law
These Terms of Service are governed by the laws of Bangladesh. Any disputes shall be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh.
9.2 User Disputes
Disputes between users (tenants and property owners) must be resolved directly between the parties. Bhara.com may provide contact information but is not obligated to mediate or resolve user disputes.
9.3 Platform Disputes
For disputes with Bhara.com (billing, account issues, etc.):
- Contact our support team first: support@bhara.com
- We will attempt to resolve disputes within 14 business days
- If unresolved, disputes may be escalated to arbitration or courts in Dhaka, Bangladesh
10. Intellectual Property Rights
10.1 Platform Ownership
Bhara.com, our logo, design, code, content, and trademarks are owned by Bhara.com and protected by Bangladesh and international intellectual property laws. You may not:
- Copy, modify, or distribute our platform or code
- Use our name, logo, or branding without permission
- Create derivative works or competing platforms
10.2 User Content License
You retain ownership of content you post (photos, descriptions). By posting, you grant Bhara.com a non-exclusive, royalty-free, worldwide license to use, display, and promote your content on our platform and marketing materials.
10.3 Copyright Infringement
If you believe content on our platform infringes your copyright, contact us at legal@bhara.com with details and proof of ownership.
11. Modifications to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. We will:
- Update the "Last updated" date at the top
- Notify users via email or in-app notification for material changes
- Provide 30 days notice before significant changes take effect
Your continued use after changes constitutes acceptance of the new terms. If you disagree, you must stop using the platform and may delete your account.
12. Service Termination
12.1 By You
You can stop using Bhara.com and delete your account anytime from Settings → Danger Zone.
12.2 By Us
We reserve the right to suspend or terminate your account immediately, without notice, if:
- You violate these Terms of Service
- You engage in fraudulent, illegal, or harmful activities
- You abuse the platform or harass other users
- We are required to do so by law or government order
- Your account has been inactive for more than 2 years
12.3 Effect of Termination
Upon termination:
- Your access to the platform will be revoked immediately
- Your listings will be deactivated and removed within 30 days
- Your personal data will be handled according to our Privacy Policy
- Subscription fees are non-refundable unless required by law
- Sections 6, 7, 8, 9 (Disclaimers, Liability, Indemnification, Governing Law) survive termination
13. Miscellaneous
13.1 Entire Agreement
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Bhara.com.
13.2 Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will remain in full effect.
13.3 No Waiver
Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.
13.4 Assignment
You may not transfer or assign your rights or obligations under these terms. We may assign our rights to any affiliate or successor.
13.5 Force Majeure
We are not liable for delays or failures due to causes beyond our reasonable control (natural disasters, internet outages, government actions, etc.).
